Welcome to Herbsts Hounds.
These Terms of Service govern your use of our website and the purchase of products from Herbsts Hounds.
By accessing our website or placing an order, you agree to these Terms of Service together with our Privacy Policy, Shipping Policy, Returns & Refunds Policy and any other policies referenced on our website.
Nothing in these Terms is intended to limit or exclude any rights you may have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other applicable South African law.
2. About Herbsts Hounds
Herbsts Hounds is a South African business supplying frozen complementary dog food and related products.
Our products are intended for use in accordance with the feeding, storage and handling instructions provided on the product packaging and website.
Our current food range is sold as complementary dog food and should be fed in accordance with the feeding directions provided.

3. Products
We make every reasonable effort to ensure that product descriptions, photographs, ingredients, nutritional information, pack sizes and other information displayed on our website are accurate.
Colours and appearance may vary slightly depending on your device or screen settings.
Product availability may change without notice, and we reserve the right to discontinue products or limit quantities where reasonably necessary.
Customers are responsible for reviewing the product's ingredient information before feeding it to their dog, particularly where a dog has a known allergy, intolerance, medical condition or specific dietary requirement.
If you are uncertain whether a product is appropriate for your dog, particularly where your dog has a medical condition or prescribed diet, please consult your veterinarian.
4. Orders
Placing an order constitutes an offer to purchase the products in your cart.
An order is accepted once payment has been successfully processed and we have confirmed your order.
We reserve the right to decline or cancel an order where reasonably necessary, including in cases of suspected fraud, payment problems, incorrect pricing, stock errors or circumstances preventing us from safely fulfilling the order.
If we cancel an order after payment has been received, any amount due to you will be refunded to the original payment method where reasonably possible.
Please check your order, delivery address and contact information carefully before completing your purchase.
5. Prices and Payment
All prices are displayed in South African Rand (ZAR).
Herbsts Hounds is not currently registered for VAT and prices therefore do not include VAT.
Delivery charges are additional unless expressly stated otherwise and will be displayed before you complete your purchase.
Prices, promotions and discounts may change from time to time. The price applicable to your purchase is the price displayed when your order is placed, subject to the correction of genuine pricing or system errors as permitted by applicable law.
Payment is processed through the payment methods made available at checkout.
6. Frozen Products, Storage and Handling
Herbsts Hounds products are frozen and perishable. Maintaining appropriate storage and handling is important for product quality and safety.
Customers should place products into the freezer as soon as reasonably possible after delivery.
If a pack has slightly defrosted during delivery, do not refreeze it. Refrigerate it and use it within the period stated in our storage instructions.
Once opened, products should be refrigerated and used within the period stated on the packaging or website.
Please follow all storage, handling and feeding instructions supplied with our products.
If you have concerns about the condition of a product when it arrives, please contact us as soon as possible. Delivery-related concerns should preferably be reported within 24 hours, together with photographs where possible, so that we can investigate what happened.
This requested reporting period does not limit any statutory rights you may have.
7. Shipping and Delivery
We currently deliver within South Africa only.
Because our products are frozen, national orders are dispatched on designated days to reduce the risk of orders remaining at courier depots over weekends.
Delivery charges, available delivery options and applicable local delivery areas are displayed at checkout.
Delivery times are estimates and may be affected by courier delays, weather, road conditions or other circumstances outside our reasonable control.

8. Returns, Refunds and Product Concerns
Because our products are frozen and perishable, we do not accept returns simply because a customer has changed their mind where applicable law permits us to exclude such returns.
If an order arrives damaged, significantly defrosted, incorrect or otherwise appears to have a problem, please contact us as soon as possible, preferably within 24 hours of delivery, and provide photographs where possible.
For other product quality concerns, we ask that you contact us as soon as reasonably possible, preferably within 14 days of delivery, so that we can investigate.
Depending on the circumstances and your rights under applicable law, an appropriate remedy may include replacement, refund or another suitable resolution.
The above requested reporting periods do not replace or limit any rights or remedies available to consumers under applicable South African law, including the Consumer Protection Act.

9. Changes and Cancellations
If you need to change or cancel an order, please contact us as soon as possible.
Because our products are frozen and perishable, we may be unable to change or cancel an order once it has been packed or dispatched.
Any cancellation or refund will remain subject to applicable South African consumer law and our Returns & Refunds Policy.
10. Website Use
You may use our website only for lawful purposes.
You may not intentionally interfere with the operation or security of the website, attempt to gain unauthorised access to our systems, introduce malicious software, use the website fraudulently, or use our website or content in a manner that infringes the rights of Herbsts Hounds or another person.
We reserve the right to restrict access to our website where reasonably necessary to protect our business, customers or systems.
11. Intellectual Property
Unless otherwise indicated, the Herbsts Hounds name, logo, branding, illustrations, photographs, product designs, written content, graphics and other original content appearing on our website are owned by or licensed to Herbsts Hounds and are protected by applicable intellectual-property laws.
You may browse our website and use its content for ordinary personal and non-commercial purposes.
You may not reproduce, distribute, modify, commercially exploit or otherwise use our protected content without permission, except where permitted by law.

Occasionally our website may contain errors relating to product information, pricing, availability, delivery charges, promotions or other information.
We may correct genuine errors and update information when necessary.
Where an error affects an order that has already been placed, we will deal with the matter reasonably and in accordance with applicable South African law. If an order is cancelled and payment has already been received, any refund legally due will be processed.

Herbsts Hounds will not be liable for losses resulting from circumstances outside our reasonable control except where liability cannot lawfully be excluded or limited.
Customers are responsible for following the feeding, storage and handling instructions supplied with our products.
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited, nor does anything in these Terms waive or restrict a consumer's rights under the Consumer Protection Act or other applicable South African legislation.

We collect and process personal information in accordance with our Privacy Policy and applicable South African privacy legislation.
Our website is hosted by Shopify, and information necessary to operate the website and process transactions may also be processed by Shopify and other service providers involved in providing our services.

By placing an order or using our services, you agree that we may communicate with you electronically regarding your order, delivery, account, returns or other service-related matters.
